Case Discussion

A foreign trade company exports a batch of canned fruit. The contract stipulates that the products shall be packed in cartons of 30 tins each, a total of 80 cases. But when the salesman delivered the goods, he changed it to 24 tins per box, a total of 100 tins.The total tins remained the same, but the buyer lodged a claim.

Analysis:

In this case, the salesman privately changed the packaging method without any negotiation with the buyer. According to the "United Nations Convention on Contracts for the International Sale of Goods", the seller must pack or pack the container in the manner specified in the contract. If the goods are not packed according to the prescribed conditions, the buyer has the right to reject the goods. This is the reason for this dispute.
