第二节 海上保险合同的民事法律关系
保险合同是一种经济合同，是调整合同当事人之间符合民事法律规定、具有民事权利义务内容的社会关系。任何一种民事法律关系都包括：
一、海上保险合同的主体（Subject of Marine Insurance Contract）
海上保险合同的主体可分为当事人、关系人和辅助人。
如下图：

1．被保险人（Insured）
2．受益人（Beneficiary）
（三）海上保险合同的辅助人
1．保险代理人（Insurance Agent）
截至2018年底，保险代理人员806.94万人。
2．保险经纪人（Insurance Broker）
1999年中国保监会成立后，批准了三家保险经纪公司，分别是广州长城保险经纪有限公司、北京江泰保险经纪有限公司和上海东大保险经纪有限公司。截至2016底，全国保险经纪机构共有450家家，保险经纪机构实现保费收入628.5亿元。
